Champ d&rsquo;application<\/h2>\n  <p>\n    Les pr\u00e9sentes Conditions g\u00e9n\u00e9rales s&rsquo;appliquent \u00e0 la collaboration entre NextGen Workforce Lda et ses clients professionnels dans les domaines de l&rsquo;IT <a href=\"https:\/\/en.wikipedia.org\/wiki\/Nearshoring\" target=\"_blank\">nearshoring<\/a>, du d\u00e9veloppement logiciel, du conseil et des services associ\u00e9s.\n  <\/p>\n  <p>\n    NextGen Workforce travaille exclusivement avec des clients professionnels (B2B). Les consommateurs ne font pas partie du public cible de nos services.\n  <\/p>\n\n  <hr>\n\n  <h2>2. Bases contractuelles<\/h2>\n  <p>\n    Le p\u00e9rim\u00e8tre concret des prestations, les prix, dur\u00e9es, conditions de paiement, r\u00e8gles de r\u00e9siliation et autres d\u00e9tails contractuels sont d\u00e9finis individuellement dans les offres, confirmations de commande, descriptions de prestations ou contrats s\u00e9par\u00e9s.\n  <\/p>\n  <p>\n    En cas de contradiction, les documents contractuels convenus individuellement pr\u00e9valent sur les pr\u00e9sentes CG.\n  <\/p>\n\n  <hr>\n\n  <h2>3. Mod\u00e8le de prestation<\/h2>\n  <p>\n    NextGen Workforce fournit des services IT dans le cadre d&rsquo;un mod\u00e8le de nearshoring entre la Suisse et le Portugal.\n  <\/p>\n  <p>\n    Nos sp\u00e9cialistes interviennent comme extension int\u00e9gr\u00e9e des <a href=\"\/fr\/modele-it-nearshoring-suisse\/\">organisations IT<\/a> existantes et soutiennent les clients notamment dans le d\u00e9veloppement, la mise en \u0153uvre technique, l&rsquo;exploitation, le conseil et l&rsquo;accompagnement de projets.\n  <\/p>\n\n  <hr>\n\n  <h2>4. Collaboration<\/h2>\n  <p>\n    La collaboration s&rsquo;effectue en coordination \u00e9troite avec les <a href=\"\/fr\/conseil-it-suisse-contact\/\">interlocuteurs<\/a> responsables du client et s&rsquo;aligne sur les structures, processus et m\u00e9thodes de travail convenus.\n  <\/p>\n  <p>La collaboration repose notamment sur :<\/p>\n  <ul>\n    <li>des responsabilit\u00e9s claires<\/li>\n    <li>une communication transparente<\/li>\n    <li>une planification fiable<\/li>\n    <li>un partenariat \u00e0 long terme<\/li>\n    <li>une int\u00e9gration professionnelle dans les \u00e9quipes IT existantes<\/li>\n  <\/ul>\n  <p>\n    Nos <a href=\"\/fr\/modele-it-nearshoring-suisse\/\">\u00e9quipes<\/a> travaillent g\u00e9n\u00e9ralement \u00e0 distance depuis le Portugal et sont int\u00e9gr\u00e9es dans le quotidien IT op\u00e9rationnel du client selon les accords conclus.\n  <\/p>\n\n  <hr>\n\n  <h2>5. Obligations de coop\u00e9ration du client<\/h2>\n  <p>\n    Le client met \u00e0 disposition toutes les informations, acc\u00e8s, interlocuteurs, conditions techniques et documents n\u00e9cessaires \u00e0 la fourniture des prestations convenues.\n  <\/p>\n  <p>\n    Les retards r\u00e9sultant d&rsquo;une coop\u00e9ration manquante ou tardive du client ne rel\u00e8vent pas de la responsabilit\u00e9 de NextGen Workforce.\n  <\/p>\n\n  <hr>\n\n  <h2>6. Disponibilit\u00e9 et organisation<\/h2>\n  <p>\n    Les horaires de travail, la disponibilit\u00e9, les canaux de communication, l&rsquo;organisation de projet et le reporting d\u00e9pendent des exigences individuelles du client et sont convenus par projet.\n  <\/p>\n  <p>\n    Sauf accord contraire, NextGen Workforce doit fournir une prestation professionnelle, mais ne garantit pas un r\u00e9sultat \u00e9conomique ou technique d\u00e9termin\u00e9.\n  <\/p>\n\n  <hr>\n\n  <h2>7. Prix et conditions de paiement<\/h2>\n  <p>\n    Les prix, mod\u00e8les de facturation et d\u00e9lais de paiement sont convenus individuellement.\n  <\/p>\n  <p>\n    Sauf indication contraire, tous les prix s&rsquo;entendent hors taxes l\u00e9gales, redevances ou autres frais.\n  <\/p>\n\n  <hr>\n\n  <h2>8. Protection des donn\u00e9es et confidentialit\u00e9<\/h2>\n  <p>\n    La protection des informations sensibles est une priorit\u00e9 absolue pour NextGen Workforce.\n  <\/p>\n  <p>\n    Toutes les prestations sont fournies dans le respect des lois applicables en mati\u00e8re de protection des donn\u00e9es, notamment le RGPD et la loi suisse sur la protection des donn\u00e9es (LPD), ainsi que des r\u00e8gles de confidentialit\u00e9 convenues contractuellement.\n  <\/p>\n  <p>\n    Lorsque NextGen Workforce traite des donn\u00e9es personnelles pour le compte du client, un accord s\u00e9par\u00e9 de traitement des donn\u00e9es est conclu.\n  <\/p>\n\n  <hr>\n\n  <h2>9. Droits sur les r\u00e9sultats de travail<\/h2>\n  <p>\n    Les droits sur les r\u00e9sultats de travail, le code source, les documentations, les concepts et autres livrables sont r\u00e9gis par l&rsquo;accord contractuel applicable.\n  <\/p>\n  <p>\n    Jusqu&rsquo;au paiement int\u00e9gral des r\u00e9mun\u00e9rations convenues, les droits d&rsquo;utilisation restent r\u00e9serv\u00e9s dans la mesure permise par la loi.\n  <\/p>\n\n  <hr>\n\n  <h2>10. Responsabilit\u00e9<\/h2>\n  <p>\n    La responsabilit\u00e9 de NextGen Workforce est r\u00e9gie par les conditions contractuelles convenues individuellement et les dispositions l\u00e9gales applicables.\n  <\/p>\n  <p>\n    La responsabilit\u00e9 pour les dommages indirects, la perte de b\u00e9n\u00e9fice, la perte de donn\u00e9es ou les dommages cons\u00e9cutifs est exclue dans la mesure permise par la loi.\n  <\/p>\n\n  <hr>\n\n  <h2>11. Dur\u00e9e et r\u00e9siliation<\/h2>\n  <p>\n    La dur\u00e9e, les d\u00e9lais de pr\u00e9avis et les modalit\u00e9s de r\u00e9siliation sont d\u00e9finis individuellement dans le contrat concern\u00e9.\n  <\/p>\n  <p>\n    Le droit de r\u00e9siliation extraordinaire pour motif grave demeure r\u00e9serv\u00e9.\n  <\/p>\n\n  <hr>\n\n  <h2>12. Droit applicable et juridiction comp\u00e9tente<\/h2>\n  <p>\n    Sauf accord contraire, le droit portugais s&rsquo;applique, \u00e0 l&rsquo;exclusion des r\u00e8gles de conflit de lois.\n  <\/p>\n  <p>\n    Le for juridique est, dans la mesure permise par la loi, Lisbonne, Portugal.\n  <\/p>\n\n  <hr>\n\n  <h2>13. Dispositions finales<\/h2>\n  <p>\n    Si certaines dispositions des pr\u00e9sentes CG sont ou deviennent invalides, la validit\u00e9 des autres dispositions reste inchang\u00e9e.\n  <\/p>\n  <p>\n    NextGen Workforce se r\u00e9serve le droit d&rsquo;adapter les pr\u00e9sentes CG si n\u00e9cessaire.
